Estate Planning and Probate
Decker
Jones attorneys provide a broad range of estate planning
and probate services to their clients to assist them
in the orderly and efficient transfer of property during
lifetime and at death.
Each
client's individual and family situation receives personalized
attention, and the firm's consultation and planning
take into account both non-tax considerations and those
arising from the income tax, gift tax, estate tax, and
generation-skipping tax. Services include the preparation
of wills; various types of trusts, including revocable
living trusts, irrevocable trusts, life insurance trusts,
charitable remainder trusts, and charitable lead trusts;
powers of attorney, including durable powers of attorney
for health care; directives to physicians, commonly
known as living wills; family limited partnerships and
other business and investment entities; and private
foundations. Attorneys coordinate estate planning for
closely-held business interests through the use of corporate
recapitalizations and other structural planning.
Probate
and post-death services include the probate of wills,
estate and trust administration, and preparation of
federal estate tax returns and state estate and inheritance
tax returns. The firm represents estate and trust fiduciaries
and beneficiaries in adversary proceedings, including
tax disputes.
