The Decker Jones’ Construction Practice Group serves the legal needs of the residential and commercial construction industries and has experience handling delay claims, construction defect claims, payment claims, bond and lien claims, and breach of contract claims on behalf of owners, developers, lenders, contractors, subcontractors, suppliers, sureties, and design professionals. Members of this Group are actively involved in various industry associations from the State Bar of Texas Construction Law Section, Texas Association of Builders, Certified Master Builder Corporation, National Association of The Remodeling Industry, and various local home building associations.
CONSTRUCTION DEFECT LITIGATION
This Group has experience representing clients in commercial construction litigation (including ADA and architectural barrier claims) and regularly counsels, represents and defends clients in pre-litigation dispute resolution, arbitration, and state and federal litigation. Homebuilding companies also face the same issues as commercial builders. The Group also represents homebuilders in all facets of construction defect and subrogation litigation in state court and arbitration, through the Residential Construction Liability Act, and before the Texas Residential Construction Commission.
MECHANIC’S LIENS, BONDS, & PAYMENT CLAIMS
Nonpayment of claims within the construction industry is a common source of construction disputes. The Decker Jones Construction Group has extensive experience in both prosecuting and defending payment claims. These cases range from the sworn account suit for unpaid labor and materials to Prompt Payment claims, to complex cases involving many types of issues.
The lien and bond perfection scheme in Texas is unique, cumbersome, and complex. Notice requirements and filing deadlines are strict and unforgiving. The Decker Jones Construction Group has extensive experience in Texas in this area including claims including claims against indemnity bonds and bonds posted under state (McGregor Act) and federal law (Miller Act).
