Construction
  • Representing developers, homebuilders (production and custom), contractors, subcontractors, suppliers, and owners in all aspects of residential and commercial construction including real estate transactions, contract preparation and negotiation, construction defect litigation and arbitration, covenants, conditions & restrictions, mechanic’s lien and bond claims, contract actions, and insurance coverage.  Also experienced representing developers and purchasers of undeveloped single-family lots from acquisition through development, zoning, permitting, construction, and sale.

Real Estate
  • Assisting clients in structuring, negotiating and closing real estate transactions of all types and represent developers, commercial real estate investors, and landlord and tenants in both commercial and residential matters.  Experience assisting clients with property restrictions and covenants, title and survey review, acquisition and disposition, real estate development, real estate related financial transactions, including negotiations with lenders, and drafting and review of construction loan agreements, deeds of trust, and promissory notes.

    Developed considerable experience negotiating work outs with lenders and litigating deficiency lawsuits following foreclosure of real estate.  Recently negotiated numerous settlements on alleged deficiencies for both the borrower and guarantor.

Mechanics Lien & Bond Claims
  • Experienced in handling payment claims, preparing and filing bond and lien claims, obtaining indemnity bonds, Texas Prompt Payment Act, and litigation to resolve payment claims.

BIO

Stephen is a shareholder with the firm and prides himself on being a top construction attorney with a strong emphasis in residential construction.  He has considerable experience representing clients in construction related matters including both at trial and in arbitration.  In addition to being general counsel to the Certified Master Builder Corporation, Hood County Builders Association, and American Society of Interior Designers, Stephen is also on the Board of Directors for the Greater Fort Worth Builders Association and is a Commissioner on the Planning and Zoning Commission for the City of Mansfield, Texas.  He represents numerous production and custom homebuilders throughout North Texas and was recognized as a “Texas Rising Star” by Thomson Reuters from 2009-2013 and a “Super Lawyer” by Thomson Reuters in 2013 and 2014.

Stephen publishes a set of form residential construction contracts that are used throughout the state and regularly negotiates construction contracts on behalf of owners and builders.  Also, Stephen has presented seminars and has authored/co-authored several articles on a variety of topics concerning the construction industry, including his monthly article “Legal Perspective,” which is published in Building Savvy Magazine.  Between 2003 and 2009, Stephen was one of a limited number of instructors who was recognized by the Texas Residential Construction Commission as an approved instructor.  He has also testified on occasion regarding pending legislation before several State committees.
